Terms of Service
The agreement between you and RecruiterPM LLC (HRTool.ai) for use of the Service.

These Terms of Service ("Terms") are a binding agreement between RecruiterPM LLC, a Florida privately held company DBA HRTool.ai ("HRTool.ai," "we," "us"), and the entity or person that creates an account or uses the HRTool.ai platform ("Customer," "you"). By creating an account or using the Service, you agree to these Terms.
1. The Service
HRTool.ai provides a hosted platform for building and delivering hiring assessments, tests, and surveys; collecting and scoring candidate responses; optional webcam proctoring; optional AI transcription and analysis of recorded answers as decision support; live video interview rooms with optional recording, live transcription, AI interviewer assistance (decision support only), and live coding exercises; programmatic access via our REST API and MCP server; and related analytics and administration. HRTool.ai is a RecruiterPM company and may be embedded into RecruiterPM and other applicant-tracking systems.
2. Accounts and eligibility
You must provide accurate information, keep your credentials secure (we require email-based two-factor authentication), and are responsible for all activity under your account and your users. You must be authorized to bind your organization. New companies may be subject to approval before activation.
3. Customer responsibilities and compliance
You use the Service as the employer/controller of candidate data. You are responsible for:
- using the Service only for lawful hiring, assessment, and survey purposes;
- complying with all applicable employment and anti-discrimination laws, including Title VII, the ADA, the ADEA, EEOC guidance, and state/local laws governing automated employment decision tools and AI in hiring (e.g., NYC Local Law 144, the Illinois AIVIA (820 ILCS 42), the Illinois Human Rights Act as amended by HB 3773, the California FEHA automated-decision system regulations, the California CCPA ADMT regulations, and the Colorado AI Act); HRTool.ai provides documentation to support Customers' Colorado AI Act deployer obligations on request;
- providing candidates any required notices and obtaining any required consents, and publishing any bias-audit results your jurisdiction requires;
- making reasonable accommodations available to candidates; and
- using assessments that are job-related and consistent with business necessity.
HRTool.ai provides supporting controls (consent capture, fairness-constrained AI, audit logging, retention tooling), but you remain responsible for your hiring decisions and your legal compliance.
4. Acceptable use
You will not: use the Service to unlawfully discriminate; attempt to re-identify, scrape, or misuse candidate data; reverse engineer or resell the Service; upload unlawful, infringing, defamatory, or obscene content; interfere with security or integrity; or exceed authorized access. You will not use AI outputs as the sole basis for an adverse hiring action.
Copyright complaints (DMCA): If you believe content on the Service infringes your copyright, send a notice meeting the requirements of 17 U.S.C. § 512(c)(3) to support@hrtool.ai (Subject: "DMCA Notice"). We will remove or disable access to material identified in valid notices, notify the user who posted it, accept counter-notices, and terminate repeat infringers' accounts.
5. Subscription, billing, and usage
The Assessment Suite is $99/month per company. Each monthly cycle includes a set allowance of completed assessment submissions and AI Media Credits; usage beyond the included allowances is metered and automatically added to your next invoice (currently $0.20 per additional completed submission and $0.40 per additional AI Media Credit). AI Media Credits are consumed when recorded audio/video answers are processed by AI, based on length. Fees are exclusive of taxes and, except where required by law, are non-refundable. Subscriptions renew automatically each month until cancelled. You may cancel at any time from your billing settings or by written notice to support@hrtool.ai; cancellation takes effect at the end of the current billing cycle, and metered overage accrued before cancellation remains payable. We may change pricing on at least thirty (30) days' notice; changes apply to the next billing cycle.
6. AI analysis disclaimer
AI-generated transcripts, summaries, and scores — including live interview copilot suggestions and answer analyses — are decision support only. The AI is constrained to evaluate job-relevant content and not protected characteristics, and a human makes every final hiring decision. AI transcripts are generated automatically and may contain errors or omissions; review transcripts and, where material, the underlying recordings before relying on them. You are solely responsible for reviewing outputs and for ensuring decisions are lawful, non-discriminatory, and consistent with these Terms.
7. API and MCP access
We may provide access to the Service via a REST API and an MCP (Model Context Protocol) server. API keys and MCP credentials are confidential; you are responsible for safeguarding them and for all activity under them. Programmatic access is licensed only for your internal hiring use, is subject to rate limits and your plan's usage allowances, and may not be used to resell the Service, extract data for unrelated purposes, or circumvent security or metering. We may throttle, suspend, or revoke keys for abuse or security risk.
8. Not a consumer reporting agency (FCRA)
HRTool.ai is not a consumer reporting agency, and assessment results, AI outputs, and interview records are not consumer reports under the Fair Credit Reporting Act. You agree not to use the Service to determine eligibility for credit or insurance, or for any other FCRA-regulated purpose, and not to combine Service outputs with background-check products in a manner that would make HRTool.ai a consumer reporting agency.
9. Candidate data and data processing
For candidate data, you are the controller and HRTool.ai is your processor/service provider, processing data on your documented instructions to provide the Service. We maintain security measures, use vetted subprocessors under contract, assist with data-subject requests, and delete or return candidate data as described in our Privacy Policy and our Data Processing Addendum (available at support@hrtool.ai), which is incorporated into these Terms together with the Privacy Policy. We will notify you of a confirmed personal data breach affecting your candidate data without undue delay, and in any event within five (5) business days, and — where legally permitted — will notify you before disclosing your candidate data in response to a subpoena or similar legal demand. We do not use your content or candidate data to train AI models.
10. Intellectual property
The Service, software, and the pre-loaded question bank are owned by HRTool.ai and licensed to you for your internal hiring use only. You retain ownership of the content and questions you create and the candidate data you collect, and you grant us the limited license needed to host and process it to provide the Service.
11. Confidentiality
Each party will protect the other's non-public information and use it only to perform under these Terms.
12. Warranties and disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service or any AI output is error-free or fit for any particular hiring decision.
13. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, and HRTool.ai's total liability arising out of or relating to the Service will not exceed the fees you paid to us in the twelve (12) months preceding the claim. These limits do not apply to a party's indemnification obligations or to liability that cannot be limited by law.
14. Indemnification
You will defend and indemnify HRTool.ai against third-party claims arising from your use of the Service in violation of these Terms or law, including claims relating to your hiring decisions, your required candidate notices/consents, or content you provide.
15. Term and termination
These Terms apply while you use the Service. Either party may terminate for material breach not cured within 30 days. You may stop using the Service at any time; we may suspend or terminate accounts that violate these Terms or law. On termination, we will make Customer data available for export for a limited period, then delete it per our retention practices.
16. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. The exclusive venue for disputes is the state or federal courts located in Palm Beach County, Florida, and the parties consent to that jurisdiction.
17. Changes
We may update these Terms and will revise the "Last updated" date; material changes will be communicated as required. Continued use after changes take effect constitutes acceptance.
